Controls of Pollution Act (1974) Controls discharge into controlled waters in Scotland. Any spills could mean unauthorised discharge. The Control of Pollution (Oil Storage) (England) 2001 Applies to premises in England storing more than 200 litres of oil. It states that bunds or drip trays are required to prevent pollution. Environmental Protection Act (1990) Introduced powers to improve control of pollution by empowering regulators (eg EA, SEPA) and introduced ‘Duty of Care’ which is both the employers’ and employees’ responsibility. Water Resources Act (1991) This act requires a “ consent of discharge” Any unauthorised discharges are classed as pollution and therefore an offense.

The Environment Agency has a series of Pollution Guidelines (PPG’s) to help you avoid pollution and to comply with the requirements of the law. PPG26 covers the Storage and Handling of Drums and IBC’s (up to 100 litres) and defines basic requirements that bunds, or secondary containment, must achieve.
